Subject: Execution of an annex to the agreement with the contractor under the implementation of the CCGT Ostrołęka project

With reference to current reports No. 40/2021, 26/2023 and 56/2025, the Management Board of Energa S.A. (the “Issuer”) hereby informs that on 16 April 2026, an annex (the “Annex”) to the agreement dated 25 June 2021 with GE Power Sp. z o.o. with its registered office in Warsaw and GE Vernova Global Services GmbH (the “Contractor”), concerning the construction of the CCGT Ostrołęka combined cycle gas turbine unit (the “Project”) implemented under the EPC (“turnkey”) formula, was signed.
The Annex introduces stabilization and mobilization mechanisms supporting the effective implementation of the Project by the Contractor.
CCGT Ostrołęka Sp. z o.o., as a subsidiary of the Issuer carrying out the Project, assumes achieving the Operational Milestone (“OM”) no later than in the first quarter of 2027. Achieving the OM will, as a rule, result in the cessation of penalties for failure to perform obligations under the Capacity Market agreement, as indicated in current report No. 56/2025, and the commencement of the provision of the capacity service.
