Subject: Dismissal of the appeal in the case of annulling the resolution of the Annual General Meeting of Energa SA of 2022 regarding the distribution of profit

Further to Current Reports 39/2022 and 2/2024, the Management Board of Energa S.A. (the "Company") announces that on January 19, 2026, the Court of Appeal in Gdańsk dismissed the appeal filed by a group of shareholders to repeal Resolution No. 5 of the Annual General Meeting of Energa S.A. dated May 20, 2022, regarding the distribution of net profit for the 2021 financial year and the allocation of this profit in its entirety to reserve capital.
The judgment of the court of first instance becomes final and binding, and the resolution of the General Meeting remains in force.
