Subject: Failure to meet the Operational Milestone deadline at CCGT Grudziądz 1 and CCGT Ostrołęka

With reference to the current reports 40/2021, 28/2022, and 26/2023, the Management Board of ENERGA SA ("Issuer") announces the failure to meet the deadline for achieving the so-called Operational Milestone ("OM") in CCGT Grudziądz 1 and CCGT Ostrołęka. The OM constitutes confirmation of the unit's readiness to deliver electric capacity under a contract concluded in the capacity market, in accordance with the requirements set out in Article 52(2) of the Act of 8 December 2017 on the Capacity Market. The failure to achieve the OM results from delays in the implementation of both projects.
Each month of delay in achieving the OM results in a loss of capacity market revenues of approximately PLN 23.22 million in CCGT Ostrołęka and PLN 17.30 million in CCGT Grudziądz, which affects the adjustment of total revenues communicated in Current Report 40/2021. At the same time, pursuant to the Act of 8 December 2017 on the Capacity Market, the monthly amount of contractual penalties accrued until the OM is achieved, in total for both units, is set at PLN 2.46 million.
