Subject: Statement of claim for the repeal of the resolution of Energa SA's Ordinary General Meeting

The Management Board of Energa SA (_quot;Company_quot;) informs that the Company received from the Regional Court in Gdańsk, 9th Commercial Division, a copy of the statement of claim for the repeal of the resolution No. 5 of the Ordinary General Meeting of the Company on 15 June 2023 on the distribution of the net profit for the financial year 2022 and allocation of this profit to increase of the supplementary capital.
The Company does not agree with the statement of claim and will submit a statement of defence within the time limit and in the manner prescribed by the applicable legal regulations.
