Subject: Decision to amicably resolve any and all disputes pertaining to the invalidity of a contract of sale of property rights resulting from renewable energy certificates between ENERGA – OBRÓT SA and one of the defendant wind farms.

In reference to current report No 37/2017 of 11 September 2017, the Management Board of ENERGA S.A. informs that on 21 May 2018 it received information that its subsidiary Energa-Obrót S.A. and one of the 22 wind farms sued by Energa-Obrót S.A. (the “Parties”) decided to amicably end any and all disputes pertaining to the invalidity of a contract of sale of property rights resulting from renewable energy certificates. The Parties deemed their co-operation under the contract challenged by Energa-Obrót S.A. definitely terminated. The Parties do not rule out establishing co-operation in the future based on a new contract. The settlement has no adverse effect on the financial result of Energa-Obrót S.A.
